FAQs for Law Enforcement

  • What is OCGA §31-2A-18?

OCGA §31-2A-18allows fully licensed physicians, with a principal practice location in Georgia, to certify and manage patients who have a qualifying condition to obtain medical cannabis. Physician certification is the only way patients can legally access medical cannabis in the state.

The law also authorizes the Georgia Department of Public Health to establish a Medical Cannabis Registry and issue medical cannabis cards to certified patients and caregivers. The card is proof that they are authorized to possess the oil.

How much medical cannabis is legal in Georgia?

Patients or their caregivers are allowed to legally possess up to 12,000 milligrams of tetrahydrocannabinol (THC) or medical cannabis.

  • How does Georgia’s law compare to other states that have adopted medical cannabis laws?

Georgia’s law is much more limited than medical cannabis laws in other states. For example, it does not legalize the sale or possession of marijuana in leaf form or authorize the production or sale of food products infused with medical cannabis. It is intended solely to protect certified persons from criminal prosecution for possessing medical cannabis.

  • What does medical cannabis look like?

Medical cannabis packaging may vary in appearance. However, the law requires that the medical cannabis be in a pharmaceutical container labeled by the manufacturer indicating the amount of tetrahydrocannabinol (THC) it contains.

  • What do you do if a card is expired?

The expiration date is found on the front of the card. If you believe a card has expired, please call 1-866-PUB-HLTH to verify it is no longer valid.
